Florida Couple Sues Fertility Clinic Over Alleged Wrong Embryo Implant

Tiffany Score and Steven Mills, a Florida couple, have filed a lawsuit against an Orlando fertility clinic after alleging that a medical error led to the implantation of the wrong embryo, resulting in the birth of a child who is not biologically theirs.

The couple are suing IVF Life, Inc., and its lead reproductive endocrinologist, Dr. Milton McNichol, claiming that the clinic mistakenly implanted another patient’s embryo into Score’s uterus in April 2025. The case was first reported by the Orlando Sentinel.

According to the lawsuit, the couple stored three viable embryos at the clinic in 2020 as part of an in vitro fertilization (IVF) process. IVF involves fertilizing eggs outside the body and preserving embryos for future implantation.

The couple said they later gave birth to a healthy baby girl, but soon noticed that the child’s physical appearance did not align with theirs. Subsequent genetic testing confirmed that the baby is not biologically related to either parent.

“This has been an unimaginable emotional shock for our family,” the couple said in a statement included in the court filing. “We trusted the clinic with our embryos and our future, and that trust was deeply broken,” they said.

Score and Mills also expressed concern that their own embryo may have been implanted in another patient. While they say they have bonded with the child, the couple stated that they would return her to her biological parents if they come forward.

“Our priority is ensuring the child ends up with her biological family, while also understanding what happened and preventing this from happening to anyone else,” the statement said.

The lawsuit is seeking emergency court orders compelling the clinic to notify all potentially affected patients, conduct comprehensive genetic testing, and disclose whether other families may have been impacted by the alleged mix-up.

An emergency hearing on the matter was held before Judge Margaret Schreiber. During the proceedings, IVF Life reportedly told the court that it is cooperating fully with the investigation.
